Terms of Service
1. General Provisions
1.1. This Agreement comes into force from the moment the User begins using the Website and remains valid indefinitely.
1.2. Within the framework of this Agreement, the following terms shall apply:
- “Xswapo”, “Website”, “Services”, “We”, “Us” mean xswapo.io and all related company products, as well as the company that owns and operates this Website.
- “User”, “You”, “Your” mean an individual or legal entity that has accessed the Website and uses its Services by accepting this Agreement.
- “Crypto Assets” mean assets that can be transferred using blockchain technology, including but not limited to digital coins, tokens, and other digital means of exchange.
- “Exchange” means the exchange of one Crypto Asset for another or for the same Crypto Asset on a different blockchain.
1.3. Unless otherwise stated, words in the singular include the plural and vice versa, and words referring to any gender include all genders.
1.4. The User agrees that this Agreement may be updated by Xswapo at any time. If the User does not accept this Agreement, they must not use or continue using the Services.
2. Personal Information
2.1. By accepting this Agreement, You expressly consent to Xswapo processing Your personal data, including transferring it outside the jurisdiction in which You reside.
2.2. We may share certain User data (including IP addresses) with business partners or government authorities upon request for the purpose of preventing and investigating illegal activities.
3. Suspension of Access to Services and Website
3.1. Xswapo reserves the right to terminate Your access to the Website at its sole discretion, including in cases of violation of this Agreement, immediately, without prior notice and without liability.
3.2. Xswapo reserves the right to block or suspend Your access to the Website at its discretion, without prior notice and without liability.
3.3. Xswapo is not obligated to provide reasons for such actions.
4. AML/KYC Policy
4.1. By accepting this Agreement, You agree to undergo AML/KYC procedures, which may be applied at any time at Xswapo's request.
4.2. As part of AML/KYC procedures, Xswapo reserves the right to request government-issued identification documents valid in Your country, as well as additional information regarding the source of funds, including supporting documents.
4.3. If identity verification is required, Xswapo reserves the right to suspend Your transaction for the period necessary to complete verification.
4.4. During AML/KYC procedures, Xswapo reserves the right to transfer frozen funds to cold storage to ensure their security.
4.5. In case of refusal to undergo AML/KYC or failure to provide requested documents, Xswapo has the right to refuse execution of Your transactions.
4.6. You guarantee that all information provided is true, accurate, current, and complete, and You bear full responsibility for its accuracy.
4.7. The KYC verification period may take up to 3 days. You may refuse to undergo the procedure, in which case a refund may be issued, except where the transaction is suspected of being related to illegal activities.
5. Refund Policy
5.1. We are not responsible for risks associated with the use of the Website, including currency and market risks. All transactions after an exchange on Xswapo are final and non-refundable.
5.2. Any decisions made by Xswapo regarding refunds are final.
5.3. Refunds may take up to 14 business days, except as provided in clause 5.10.
5.4. In case of significant market changes, Xswapo reserves the right to suspend fixed-rate exchanges and execute transactions at the market rate or issue a refund.
5.5. Xswapo is not responsible for funds sent to phishing websites.
5.6. In limited circumstances, Xswapo may hold User funds for up to 1 year.
5.7. Fake or fraudulent tokens are not eligible for exchange or refund.
5.8. In cases of suspected fraud, Xswapo may take measures to prevent loss of funds.
5.9. If the User deposits an amount below the minimum threshold, no refund will be issued.
5.10. If a deposit is made via an incorrect network or without a MEMO/tag, Xswapo does not guarantee a refund.
6. Prohibited Jurisdictions
6.1. By using the Website and Services, You represent and warrant that You are not located in, a citizen of, or a resident of the United States of America or any country subject to United Nations sanctions or where cryptocurrency is prohibited by law.
6.2. Xswapo reserves the right to determine the jurisdictions in which it operates and may restrict Services in certain countries.
6.3. Xswapo may use various methods to prevent access by restricted Users. You must comply with this section even if such methods can be bypassed.
6.4. Xswapo reserves the right to confiscate funds of Users from restricted jurisdictions and, at its discretion, transfer them to charity.
6.5. Use of the Website is void where prohibited by law.
6.6. Xswapo may use IP address detection to identify restricted jurisdictions and deny access accordingly.
